Quixtar Sues MonaVie and Brig Hart

Details are sketchy but it looks like Quixtar is suing MonaVie and Brig Hart, possibly related to the Team (Orrin Woodward & CO) leaders announcement of using MonaVie as a supplier.

Here is a link...

Quixtar v. MonaVie

Another poster at Get The Facts - The Truth About Amway and Quixtar added information found on the PACER web site:

January 29, 2008
Quixtar Inc. v. Hart et al FL Middle Adams Other
Petitioner: Quixtar Inc. Respondent: John Hart, Lita Hart

My question is...

How long can Quixtar attorney's force people to stay with a company that is in such chaos?

Update: The MonaVie suit appears to be a "motion to comply" with a subpeona, not an actual lawsuit.  No update on the Brig Hart portion.

Building On A Budget Launches On Thursday!

There are 18 hours to go before my friend, Mike Dillard launches Building On A Budget.

Mike wants to teach you how to create 10 to 50 leads a day for FREE!  I already create a lot of leads online for free, but I guess, I'm greedy.  I want to create more, so I can't wait until 1PM Eastern when the program launches.

Make sure that you go to: http://www.BuildingOnABudget.biz at 1PM Eastern/10AM Pacific because Mike is giving away a bunch of extra goodies on Thursday.

Direct from Mike Dillard:

Bonus #1: Get A Free Copy Of The "Building On A Budget Tele-Clinic"

As you might remember, I actually held a phone based "tele-clinic" for Building On A Budget a few months ago which was incredible. Participants paid $25.00 each just to attend this single phone call, and people were blown away by what they learned.

Here's just one of many emails I received after the call was over...

"These Methods Are Much More Powerful Than More Expensive Options!"    "Wow! I am thrilled to death that you shared this information with us. The content of this course is jam-packed with step-by-step instructions on exactly what to do to drive traffic to your site for under $500, but the best part is that these methods are much more powerful than a lot of the more expensive options.

Thanks a million Mike." - Tim Berry MD

So as a special gift tomorrow, I'm going to give you FREE instant download access to the recording of this call which you'll definitely want because it contains two additional free traffic generating methods which aren't in the book.

Bonus #2: Get A Free Copy Of My Private "Inner Circle Newsletter"

The 5 methods we chose to teach in BOAB are going to be extremely effective for years to come because they aren't based on "here today, gone tomorrow" tricks.

But none-the-less, the internet is constantly evolving, and little changes take place all the time. If you're familiar with the "Google Slaps" that took place in 2007, you know exactly what I'm talking about.

If you tried to keep up with the latest tactics on your own for PPC, SEO, blogging, video, and social networking sites, you'd end up spending about $3,000/Mo on courses and frankly, you wouldn't have time to do anything else but read!

Well we've decided to make sure that's never going to be a problem for you.

After being asked to do this by thousands of people, my marketing team and I have decided to produce a private monthly newsletter called the "Magnetic Sponsoring Inner Circle", which is strictly reserved for personal friends and customers.

We have to keep up on all the latest online marketing strategies because we own some of the biggest websites in the industry!

So why not pass on the best of what we learn each month from our personal real-world tests and results, to you? Well that's exactly what we're going to do...

Each month, we'll be producing a new issue of the "Inner Circle", and inside you'll find the latest, most effective online marketing techniques boiled down into a few simple steps,

This kind of information is mandatory for anyone who wants to stay competitive and build a huge online business without having to spend thousands of dollars per month on the latest courses.

And the information you'll get is even more valuable because it's not theory. You actually get to see what's working behind the curtain of our multi-million dollar marketing company!

When you order BOAB tomorrow, I'll send you the very first issue of the Inner Circle for FREE.

Bonus #3: Get Exclusive 35%-60% On "Traffic Formula", "Black Belt Recruiting", And "System Formula"

As soon as you're order is processed, you'll have the opportunity to get copies of our other courses at the lowest prices we've EVER offered, including two that haven't been released yet... "Black Belt Recruiting" and "System Formula". These discounts are reserved for "Building On A Budget" Customers only and are not available to the general public!

I know that many of you have been waiting to get your hands on these two courses for a while, so now is your chance to get them months before they're available to everyone else, and at prices you'll never see again!

Bonus #4: Get A Huge Discount On Your Copy Of "Building On A Budget"

As I mentioned in the last email, one of the goals I had when I wrote this course was to make sure everyone can afford it, so the normal price is going to be just $49.95.

But that's not you're price... It's everyone else's.

As my fourth and final bonus, you're going to get a BIG discount Ty!

How big? I can't tell you publically, so you'll just have to visit www.BuildingOnABudget.biz at 1:00 EST tomorrow to find out! ;)

Thank you for your leadership, Mike Dillard

Back to Ty....

Thursday is going to be a wild day.

Don't miss this.

'til next time,

Achieve!

Herbalife Grows 22% In 2007 In The U.S.!

Quixtar IBO's, you need to pay attention to this!. Sorry to pick on you here, but as I have been trying to tell you, companies in Network Marketing are growing...even older companies like Herbalife.  Check this out:

The company attributed the increase in sales to double-digit growth in several of its top countries, coupled with favorable foreign currency fluctuations. U.S. sales grew 22 percent, while revenue in Taiwan rose 19 percent, Italy 22 percent and China 146 percent.

If your business is not growing, look at the overall growth of your company.  If the company  not growing either, you need to seriously consider the company you are affiliated with.  Life is too short to spin your wheels with a company that is in chaos.  Do some research and take control of your future

MLM Uncensored

About four months ago, I launched three new blog sites that were experimental in nature.  Typically, blog content is created by one writer and then the blog readers have the opportunity to comment on the blog posts presented by the writer.

In my five years of blogging, I have written a number of blog posts that have taken on a life of their own in the comment sections.  People would post points and counter-points and engage in wonderful (and many times civil) debates about the topics.

This spawned an idea to create a blog that offered content created solely by the readers and that's what I did (in fact, I created three such blogs) and I called them MLM Uncensored.

All three of the sites landed in the Google Top 10 when searching for the company name at one point or another over the last four months and one remains in the top 10 today.  The sites have all bounced around the top 40 depending on what is written how Google shuffles the cards.

What does this mean to you?

It's simple, really.  We will be launching additional MLM Uncensored sites at a clip of at least one a week and we want you to participate and benefit from your participation.  You are free to post your links and promote your business in any way you see fit.  Others are free to comment about the posts and about the company in general, including their opinions and their experience with the product and opportunity.  It's an uncensored free flowing discussion.  The only time we will moderate comments is if people get abusive. I have no time for abusive people in my life and I assume that you don't either.

Here are the links to the three original sites:

Body Alive Uncensored
MonaVie Uncensored
Zrii Uncensored

and our newest launch:

"Only Stupid Do MLM The Old Fashioned Way"

That is a direct quote from a web page that I recently stumbled across.  Outside of the statement being untrue, there is another major problem with the web page.

See if you can spot it. Click Here.

Update: The problem I found has been fixed. The site didn't have a place to capture a persons information.  It was a lead capture page without the capture at the time I first looked at it.

Update 2: I responded to a comment from the author of the web site in the comments and I thought it might be worth posting a couple of additional thoughts here.

Absolutes are stupid and in this case, wrong.  People have the right to say whatever they want, but when they state something as a fact and they are wrong, I have a right to point that out.  Even though I use the Internet to create leads (and I am really good at it), to suggest that face to face contacting and business building doesn't work is simply naive.

As a matter of fact, my buddy, Todd Falcone (a multi-million dollar earner himself), interviewed a bunch of six and seven figure Network Marketing income earners about this very subject...

Check it out.

What Makes A Good Network Marketing Company?

Mlmhesaidshesaid_2 Ever hear someone say, "My ORAC is higher than your ORAC!" or "My company is better than your company."?  There is little doubt that there are good companies and bad companies in this industry, the question should be what attributes make a good company?

We will touch on this subject over the next few weeks in this multi-part series.  Your comments are welcome and encouraged.

There are attributes of a Network Marketing company that are important and then there are attributes of a Network Marketing company that people love to toss around as a perceived benefit, but these make little to no difference in whether or not you are able to build a profitable business. Let's talk about a few of these attributes...

1. Size and Longevity Of The Company - This is a very important piece to the puzzle when choosing a Network Marketing company, but it really comes down to stability, not size and longevity. You want a company to have the resources to grow and the stability to pay out bonus checks on time, ship products on time and support your business through providing excellent customer service.  I normally suggest that people stay away from start-up companies, but if Bill Gates and Warren Buffet start a company, is it really a start up or is it a new company? It's important to look closely at the ownership.

Remember, just because a company is the biggest and oldest, doesn't mean it is the best place for you to carve out your own success. This is about your personal success in your marketplace, not about a companies 50 year track record and billions in sales in other countries.

I will take a stable, innovative and growing company over a billion dollar, 50 year old company that is in chaos in my marketplace.

2. Number Of Products: More Is Better? -The myth is that more products choices leads to more volume. But the facts tell a different story.  The fastest growing companies in the last 5 years in Network Marketing have been one product companies or companies with a very narrow product focus (like weight loss). Here is the reality of Network Marketing...people do enough volume to quality for the bonus schedule, regardless of the number of products and then if the product is innovative, reasonably priced (it doesn't have to be the cheapest) and solution driven, distributors will naturally sell the product to customers, creating more volume.

Hundreds, thousands (or even millions) of products do not significantly increase the volume or more importantly, profit per distributor.  It's really all about the impact of the product.  Network Marketing companies have always been innovative when it comes to products, but if the product is easily copied (then sold for a lot less in stores), a drop in sales will naturally occur.

I would rather have one impact product that is reasonably priced than a million products that are priced 20 to 50% higher than the stores.

Isagenix Launches Helathy Chocolate Product - IsaDelight

Isagenix has launched a new healthy chocolate product in the same genre as Network Marketing company, Xocai.

Isagenix_chocolate This powerful new treat is packed with feel-good vitamins, minerals and a unique blend of amino acids. IsaDelight™ enhances the health benefits of chocolate and helps to lift mood*, promote brain and heart health*, improve energy and satisfy cravings.*

"Isagenix is the first company to come out with a tasty chocolate supplement fortified with brain-healthy* nutrients," says Paul Anderson, M.D., D.A.P.M. and a developer of IsaDelight™. "It gives our brain the nutrients it needs and helps to elevate mood and curb food cravings.*"

The antioxidants in dark chocolate help protect the body from damaging free radicals* that lead to poorer health. Dark chocolate also helps maintain healthy blood flow to the heart and brain.* While chocolate is usually associated with high amounts of sugar and calories, each IsaDelight™ supplement is low in both.

Federal Court Overturns Texas Law Banning Passion Parties

NewsChannel 5:

An appeals court has overturned a Texas statute outlawing sex toy sales.

The ruling by the 5th U.S. Circuit Court of Appeals in New Orleans leaves Alabama as the state with the strictest ban on such devices.

Tuesday's ruling says the Texas law making it illegal to sell or promote obscene devices -- violates the 14th Amendment on the right to privacy.

Companies that own Dreamer's and Le Rouge Boutique, which sell the devices in Austin, and retailer Adam & Eve, sued in 2004.

They appealed after a judge dismissed the suit.

The Texas Attorney General's Office, which represented the Travis County district attorney, has not decided whether to appeal.

In 2004, a woman in Burleson was arrested for selling two sex toys to undercover officers.

Passion Parties consultant Joanne Webb was charged with violating the state's obscenity law. A judge later dismissed her case.

Quixtar 2007 Sales Results

This is less of a dip in sales than I expected but it is important to consider that there has been zero growth at Quixtar over the last 5 years...

ADA, Mich., Feb. 15 /PRNewswire/ -- Quixtar Inc. today announced fiscal 2007 sales of $1.072 billion, the fifth consecutive year in which the company surpassed the billion-dollar mark. The results represented a slight decline from the previous year's sales of $1.12 billion, which were the best in Quixtar's nine-year history.

Results were affected minimally by actions the company took to terminate the business of a few Independent Business Owners in August of 2007 after they refused to change unacceptable practices.

Quixtar Independent Business Owners (IBOs) earned $363 million in bonuses and other incentives for their business efforts in 2007, which also included $70.1 million in sales at Quixtar's Partner Stores.

In 2007, Quixtar launched a new line of nutritional snacks, juices and supplements for busy families under the Simply Nutrilite(TM) brand, as well as the new ARTISTRY(R) essentials line of skin care and cosmetics products. Quixtar.com was redesigned to improve usability and to better support IBO sales efforts, and Quixtar University was launched to provide online and aided sales and brand training to help IBOs build profitable businesses.

Since 1999, IBOs have earned nearly $2.6 billion based on total Quixtar sales of more than $7.86 billion and Partner Store sales of more than $577 million. Driven by its strong Health and Beauty brands, Quixtar again was ranked #1 in online Health and Beauty sales by Internet Retailer's "Top 500 Guide" in 2007, and 22nd overall in e-commerce.

"Our business is on the right path at the right time," said Jim Payne, Executive Vice President - Amway & Quixtar. "New leadership was brought in this year with Steve Lieberman, the new Managing Director for Quixtar who joined us in August. We also recently hired a new VP of Sales, Sandy Spielmaker, who will have a tremendous impact on our sales team."

Plans were announced in 2007 to change the business opportunity brand in North America to better leverage and align with Amway's $7 billion global business.

"We're working with IBOs to properly position our North American business within the context of the larger Amway global brand," said Lieberman. "To better support IBO efforts, we are focusing in particular on how consumers interact with our products and our brands."

"Our goal is to provide the best business opportunity in North America," said Lieberman. "From products and IBO compensation to sales training and marketing programs, everything we do in support of our IBOs is being examined to ensure we achieve that goal."

Orrin Woodward on Internet Critcism

I pulled this from Orrin Woodward's Leadership Blog. Interesting commentary from Orrin on Internet Criticism (note the bold portion):

At first I took it personally, but then I realized I had to take it professionally.   I had the opportunity to go to an Atlanta Falcons football game with John Maxwell and asked him how he handled criticisms.  He told me, "Orrin always, always, always, take the high road!"  I will never forget that pearl of wisdom.  Some of the things stated had suggested motives for my behavior that were simply not true.  But I am thankful that it happened to me.  It was the first time I read the criticisms online with a spirit of confronting reality.  I asked myself, “What parts of the criticisms have an element of truth and what can we do to fix them?”   This was a humbling exercise, because I had to admit our business was not perfect and needed to be reformed in several areas.  The criticisms online were right in many areas.  I told Ken McDonald back in 2004, “It’s not the negative lies online that are killing us, but the negative truths.” He agreed and said we needed to fix them.

Orrin Woodward Teams With MonaVie?

A court injunction doesn't allow Orrin Woodward to do anything for at least another 45 days, but it looks like Orrin will bring on MonaVie as one of his suppliers in the near future.

Just a guess, but I suspect that Orrin is thinking bigger than just MonaVie.

More commentary and analysis to come soon.  Off to my son's basketball game!

Bill Gouldd Is Good For Amway

I sometimes say that Amway/Quixtar arguably has the worst reputation in the Network Marketing industry.  When I say that, I am generally speaking about companies that are still in business.

Bill Gouldd's Equinox is a prime example of a company that might have a worse reputation than Amway/Quixtar partially because they were shut down by the FTC and partially because of the owner Bill Gouldd.

Now Bill Gouldd appears to be back and attacking his detractors.  This is probably good news for Amway/Quixtar because there is now someone else out there for people to talk about.

Check out Gouldd's new web site here (fur coat, f-bombs and all).

Update: I watched most of the Bill Gouldd video and really only heard one f-bomb, the rest of the video had to do with his current lifestyle, (apparently he has done well since the demise of Equinox) and some new thing that he is keeping secret but will make billions (not MLM).

I have also spoken with a handful of people that I greatly respect in the Network Marketing industry who are familiar with Gouldd.  They all say his training is top notch.

Court Tosses Out Amway/Quixtar Arbitration?

Lawschool I am not an attorney, even though I think it would be fun to play one on Boston Legal, but I think this is pretty big...

It looks like the courts ruled Amway/Quixtar Arbitration "illusory and unenforceable".

In the recent past, if you sued Amway/Quixtar you went to arbitration and the arbiters were actually trained by Amway/Quixtar employees and high level distributor leaders, leaving little hope for a win against the company.

This ruling apparently tosses out arbitration.

Exposing Yourself and Your Business

Flasher I thought that the subject line for this post might get your attention.

I want to talk about exposure and not the type of exposure that some of you might be thinking about. I am talking about getting exposure on the web.

Here is something that I know for a fact.  Bloggers (in general) are always looking for topics to write about.

How would you like to use that little bit of knowledge to your advantage?

Let's say for example, you are building a Shaklee business. (I picked Shaklee because it was fresh in my mind from talking to a Shaklee rep. recently but any company would work).

Think about the biggest thing going for your company right now. When I think of Shaklee, I think of how well the company lines up with the current trends on global warming and thinking greener.

So let's do a Google search on "Global Warming Blog".

I found this site: http://www.realclimate.org/

On the "About" page for the Real Climate blog is a way to contact the author.

Here is the exact quote from the site:

"If you would like to contact us, suggest a topic to be covered, contribute a relevant commentary, or be part of this effort on a more permanent basis, please email RealClimate (replace -at- with @)."

You see? This site is asking for your help with topics and commentary.  I would bet that if you composed a well thought out article about how Shaklee is leading the way in making sure that what they produce has no impact on global warming and the environment, this blog would be interested in publishing it. (Shaklee actually plants trees for every box of products that they ship out of their company and no, I am not involved with Shaklee).

The article must provide valuable content and can not be a hype filled - pimp your deal advertisement. You would really need to take your time and write something special.

If you did write something and the site decided to publish it, you might be a very happy Shaklee rep.

I did a quick check on some stats about realclimate.org:

Google Page Rank: 7

Alexa Ranking: 129,512

The site is very powerful and if you can get them to link to your Shaklee site, you will likely see some great benefit.  The Google Page Rank of 7 is huge.  That means that Google really trusts what this site says and will likely index it quickly and rank articles on a subject very highly.

Again, this would work with any company.  Figure out the hottest trend with your company and capitalize on that trend by submitting an article about it to a blog on that subject.

That tip could net you tens of thousands of dollars in the next year if it was seriously applied.

Orrin Woodward's Leadership Blog

Former Quixtar Leader and Founder of "The Team", Orrin Woodward has been blogging on a very regular basis at his site, Orrin Woodward Leadership Team. The posts are very good and I suggest you have a look.

In addition to the leadership and occasional political postings, Orrin has hinted that he will be able say a lot more on February 10th, once his gag order is over.

For those of you who are not familiar with Orrin, he was a high level Quixtar IBO who has left the company along with thousands of his TEAM members.

Sales At Quixtar Down - Amway Sales Up

2007 Quixtar Sales Announced...

mLive:

Amway_logo Sales at Quixtar, its direct-selling arm in the United States, fell slightly but still topped $1 billion for the fifth consecutive year, according to the company.

Quixtar faced a major revolt among its distribution base in 2007 as the company tried to reform business practices and weed out distributors the company said would not agree to its new terms. The dust-up resulted in lawsuits and the resignation of more than 15,000 distributors.

Alticor reiterated its plan to do away with the Quixtar name, saying it would transition back to using the Amway brand by the end of 2009.

The company said 70 percent of its Amway affiliate markets -- 39 of 55 -- posted sales increases during 2007. Alticor said such growth shows it can grow in established as well as emerging markets.

The company said sales were robust in Asia, especially China, where the government has settled regulatory uncertainties and Amway sells through 180 retail stores.
